Terms of Service

Introduction
Welcome to Seadanse, an AI video generation service available at seadanse.com (the "Site"). By accessing or using the Site you agree to be bound by these Terms of Service (the "Terms"), which govern your use of the Site and of everything the Site provides (the "Service").
Please read these Terms before using the Service. If you do not agree with any part of them, do not use the Site or the Service.

Eligibility
You must be at least 18 years old, or have reached the age of majority where you live, to use the Service. By using the Service you represent that you meet that requirement. If you are using the Service for a company or other organisation, you represent that you are authorised to bind that organisation to these Terms.
Accounts
Some features require an account. You may create one with an email address or by signing in with Google. You agree to give accurate information when you register and to keep it current. You are responsible for keeping your credentials safe and for everything that happens under your account, whether or not you authorised it. Tell us immediately at [email protected] if you believe your account has been used without your permission.
Credits, plans and payment
The Service is metered in credits. A render costs a number of credits that depends on the model, the resolution and the clip length, and the cost is shown before you submit.
How credits are granted
- Sign-up credits. New accounts receive a one-time credit gift so you can see what the Service produces. It is granted once per account, has no cash value, and is not exchangeable for cash or for paid credits.
- Subscription credits. A paid plan grants credits every 30 days. They are for that cycle: unused subscription credits expire at the end of the cycle and do not roll over.
- Top-up credits. Credit packs bought outside a subscription are valid for 365 days from purchase.
We may revoke credits granted for free where we detect duplicate accounts, automated sign-ups, fraud or other abuse.
Charging and failures
Credits are held when you submit a render and are charged when the render succeeds. If a render fails on our side or on a model provider's side, the held credits are released back to your balance automatically. You do not need to contact support for a failed render.
A render that completes is charged even if you are unhappy with the result. Generative models are probabilistic: the same prompt can produce different output on different runs, and a result you do not like is not a failure of the Service.
Prices and billing
Payments are processed by Stripe. We do not receive or store your card number. By providing payment details you authorise us and our payment processor to charge the fees that apply to your plan or purchase.
We may change prices. A change to a subscription price takes effect from your next renewal, and we will tell you before it applies.
Cancellation
You can cancel a subscription at any time from your billing settings. Your plan stays active until the end of the billing period you have already paid for, and no further charges are made. A cancellation has to be made before the next billing date; if it is not, that period is charged and, as set out in the Refund Policy, that charge is not refunded. We do not issue prorated credits or partial refunds for unused time, mid-cycle cancellations or downgrades.

Your content
Ownership
You keep ownership of what you upload and of what you generate with the Service ("Your Content"). Subject to your compliance with these Terms, you may use the videos and images you generate commercially.
You are solely responsible for Your Content, including for holding the rights to anything you upload as a reference image, a first or last frame, or a motion source.
The licence you give us
To operate the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, reproduce and display Your Content, and to send it to the model providers listed in our Privacy Policy, for the purpose of producing and delivering your renders, keeping them available in your account, and supporting and securing the Service. This licence lasts as long as we hold the content and ends when the content is deleted.
We do not use Your Content to advertise the Service without your permission, and we do not sell it.
Content you may not create or upload
The Service is designed to avoid adult, violent and sensitive output, but generative models are unpredictable, which is one reason the Service is for adults only. The following is prohibited:
- Illegal content — anything that promotes, enables or takes part in illegal activity, including fraud and the sale of illegal goods or services.
- Sexual content involving minors — under no circumstances, in any form, including stylised or animated depictions. We report this to the relevant authorities.
- Explicit or adult content — pornography, sexualised depictions of real people, and gratuitous violence or gore.
- Another person's likeness or voice without permission — including deepfakes and impersonation meant to mislead, defraud or harass.
- Hate, harassment and incitement — content that attacks or degrades people on the basis of race, ethnicity, national origin, religion, gender, sexual orientation, disability or any other protected characteristic, and content that targets an individual or group in order to harass, threaten or bully.
- Self-harm — content promoting or glorifying suicide, self-harm or other dangerous behaviour.
- Intellectual property infringement — content that infringes someone else's copyright, trademark or other rights.
- Deceptive content — output presented as a real recording, as human-made, or as endorsed by a real person or organisation when it is not.
- Privacy violations — content that exposes someone's personal information without their consent.
- Spam, malware and phishing.
You also agree not to reverse engineer, decompile or disassemble any part of the Service; not to use bots, scrapers or other automated systems to access the Site outside a documented API; not to resell or redistribute access to the Service as if it were your own; and not to interfere with the Service or the infrastructure behind it.
Enforcement
We may remove or restrict content that breaks these rules, immediately and without prior notice, and we may suspend or terminate an account that does. Where a breach is serious we may report it to the relevant authorities. Credits are not refunded on an account terminated for a breach of these Terms.
Our intellectual property
The Site, the Service and everything we provide in them — software, text, layout, graphics, logos and trademarks — belong to us or to our licensors. These Terms grant you no rights in them beyond what is stated here. "Seedance", "Hailuo", "MiniMax" and other model names are the marks of their respective owners and are used to identify the models the Service runs; their owners do not endorse this Service.
Any feedback or suggestion you send us about the Service may be used by us without restriction and without any obligation to you.
Availability, warranties and liability
The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free or free of harmful components, and to the fullest extent the law allows we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. Generative models depend on third-party providers, and a provider's capacity, pricing or availability can change without notice to us.
To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost data or lost business, arising from your use of the Service. To the maximum extent the law allows, our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.
Nothing here excludes liability that cannot be excluded under the law that applies to you.
Indemnity
You agree to indemnify and hold us harmless from claims, damages, losses and reasonable legal costs arising out of Your Content, your use of the Service, your breach of these Terms, or your infringement of anyone else's rights.
Termination
You may close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms or if we are required to by law. On termination your licence to use the Service ends immediately. Unused credits are forfeited on termination unless the Refund Policy says otherwise. Provisions that by their nature should survive — payment, intellectual property, disclaimers, limitation of liability and indemnity — survive termination.
Changes to these Terms
We may update these Terms. The effective date at the top of this page shows when the current version took effect, and continuing to use the Service after a change means you accept it. Where a change materially reduces your rights we will give notice on the Site before it takes effect.
General
These Terms are the entire agreement between you and us about the Service and replace any earlier agreement about it. If a provision is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them without restriction.
